These terms govern your use of getlaunchday.com (the "Site") and your purchase of Framer website templates sold under the Launchday brand (the "Templates"). By using the Site or buying a Template, you agree to them. If you do not agree, do not use the Site or buy a Template.
1. Who we are
Launchday is operated by Harjot Singh Rana, an individual (sole proprietor) based in India ("Launchday", "we", "us"). There is no company behind the brand. You can reach us at support@getlaunchday.com.
2. What we sell
We sell premium Framer website templates. The first is "Launchday", priced at $99 USD as a one-time payment. Until it is released, Launchday is sold as a preorder at $49 USD, 50% off that price. We also publish a free template, "Launchday Lite", on the Framer marketplace. More Templates may follow. Prices are shown in US dollars on the Site and include applicable sales tax or VAT. Creem calculates the tax inside that price at checkout.
Templates are digital goods. We do not sell or ship physical goods.
3. Payments and Creem as merchant of record
Payments are processed by Creem (creem.io), which acts as the merchant of record for every paid order. This means Creem takes your payment, calculates and collects the applicable sales tax or VAT, issues your receipt or invoice, and handles refunds and chargebacks on the payment side. Creem appears on your card or bank statement. We never see or store your card details.
When you check out, you also enter into Creem's own terms and privacy policy with respect to the payment. Those are available on creem.io. If you have a payment problem, you can contact us or Creem.
4. Delivery
After payment, your purchase confirmation includes a Framer remix link. Opening the link copies the Template into your own Framer account. Delivery is digital and immediate. You need a Framer account to use the link, and Framer's own plans and terms apply to how you publish and host a site built from the Template. Framer is a separate company and we do not control it.
You get free updates to the Template you bought. We decide when and whether to release an update, and we do not promise a release schedule.
Keep your remix link private. It is for your use under the license and must not be shared or posted publicly.
5. License
Your license to use a Template is set out in the License and summarized here. One purchase covers use of the Template on one end product or website, either your own or one client's. You may modify the Template for that use. You may not resell, redistribute, sublicense, share or give away the Template itself, in whole or in part, in original or modified form. That includes listing it, or anything derived from it, as a template on the Framer marketplace or any other marketplace or template store. The License controls if it differs from this summary.
Launchday Lite is free, but the same restrictions on resale and redistribution apply, and Framer's marketplace terms apply to it as well.
Third-party components (for example fonts, images or Framer plugins) used in a Template keep their own licenses.
6. Ownership
We keep all rights in the Templates, the Launchday name and logo, and the Site, except for the license granted to you. Content you add to your own site stays yours.
7. Acceptable use
Do not use the Site or a Template to break the law, infringe someone's rights, spread malware, or misrepresent yourself. Do not scrape, overload or attempt to break into the Site. Do not use the Launchday name or logo in a way that suggests we endorse you or your site.
8. Refunds
Our Refund Policy is part of these terms.
9. Disclaimers
Templates and the Site are provided "as is" and "as available". We try to make Templates work well, but we do not promise they will be error-free, that they will suit your particular purpose, or that they will keep working if Framer changes its platform. We do not promise any business result from using a Template, such as traffic, sales or search ranking.
Nothing in these terms excludes rights you have under mandatory consumer law where you live.
10. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue, data or goodwill, arising from your use of the Site or a Template. Our total liability for any claim relating to a Template is limited to the amount you paid for that Template. For free templates and the Site, our total liability is limited to INR 1,000.
11. Termination
We may revoke your license and remix access if you materially break these terms, for example by reselling or redistributing a Template. You can stop using a Template at any time. Sections that by their nature should survive termination, such as ownership, disclaimers, liability limits and governing law, continue to apply.
12. Governing law and disputes
These terms are governed by the laws of India. The courts of New Delhi, India have exclusive jurisdiction over any dispute that cannot be resolved informally, subject to any mandatory consumer rights you have in your country of residence. Please contact us first at support@getlaunchday.com so we can try to sort it out.
13. Changes
We may update these terms. The date at the top shows the latest version. If we make a material change, we will update the date, and for changes that affect paid customers we will email them where we have their address. Changes apply to purchases made after the update date. Continuing to use the Site after a change means you accept it.
